Welcome to Gallery Mirage. By accessing or using our platform, you agree to be bound by these Terms of Service. Please read them carefully.

1. About Gallery Mirage

Gallery Mirage is a marketplace platform that connects artists and collectors. We provide tools for listing, buying, selling, and auctioning original artwork. Gallery Mirage acts as an intermediary facilitating transactions between buyers and sellers.

2. Account Registration

To use certain features of Gallery Mirage, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activity under your account

You must be at least 18 years old to create an account and use our services.

3. KYC Verification

To sell artwork on Gallery Mirage, sellers must complete identity verification (Know Your Customer). This process requires a valid government-issued ID and personal information. We reserve the right to decline or revoke verification at our discretion.

4. Listing and Selling Artwork

When listing artwork for sale, you represent and warrant that:

• You are the rightful owner or have authorization to sell the artwork
• The artwork is authentic and as described in your listing
• All information provided (materials, dimensions, provenance) is accurate
• The artwork does not infringe on any third-party intellectual property rights

5. Commission and Fees

Gallery Mirage charges a 10% commission on all completed sales and auctions. This commission is automatically deducted from the sale price before the payout is transferred to the seller. There are no listing fees.

6. Auctions

When listing an artwork as an auction:

• You set a starting price and duration (7, 14, 30, 60, or 90 days)
• Bids are binding — bidders commit to purchasing at their bid price
• The highest bid at the end of the auction wins
• Auction settings (start price, duration) cannot be changed after listing
• Gallery Mirage reserves the right to cancel auctions that violate these terms

7. Payments

All payments are processed securely through our payment provider (Stripe). Buyers pay at the time of purchase or when winning an auction. Sellers receive their payout (sale price minus 10% commission) after the buyer confirms receipt of the artwork.

8. Shipping

Sellers are responsible for shipping artwork to buyers in a timely manner and in appropriate packaging. Sellers must ship to the address provided by the buyer. Shipping costs and arrangements are the responsibility of the seller unless otherwise agreed upon.

9. Gallery Mirage Guarantee

We offer the Gallery Mirage Guarantee on all transactions:

• Secure Checkout: All payments are encrypted and processed securely
• Money-Back Guarantee: Buyers may request a refund if the artwork is significantly not as described
• Authenticity Guarantee: We take measures to verify the authenticity of listed works

10. Prohibited Content

You may not list or sell:

• Counterfeit, forged, or misattributed artwork
• Stolen property or artwork obtained illegally
• Content that is obscene, defamatory, or violates applicable laws
• Items that infringe on intellectual property rights

11. User Conduct

You agree not to:

• Use the platform for fraudulent or deceptive purposes
• Manipulate auction bids (shill bidding)
• Harass, threaten, or abuse other users
• Attempt to bypass our commission or payment systems
• Reverse-engineer or interfere with the platform's operation

12. Account Termination

We reserve the right to suspend or terminate your account at any time if you violate these terms. You may also delete your account at any time through the app settings. Upon termination, active listings will be removed.

13. Intellectual Property

Artists retain full ownership and copyright of their artwork. By listing on Gallery Mirage, you grant us a limited license to display your artwork images on the platform for the purpose of facilitating sales. This license ends when you remove the listing.

14. Limitation of Liability

Gallery Mirage is provided "as is" without warranties of any kind. We are not liable for:

• Disputes between buyers and sellers
• Loss or damage during shipping
• The authenticity of artwork beyond our verification process
• Any indirect, incidental, or consequential damages

Our total liability shall not exceed the commission fees paid to us in the relevant transaction.

15. Dispute Resolution

In the event of a dispute, we encourage users to first attempt resolution through our chat system. If a resolution cannot be reached, Gallery Mirage may mediate at our discretion. For unresolved disputes, the laws of Austria shall apply, and the courts of Austria shall have jurisdiction.

16. Changes to These Terms

We may update these Terms of Service from time to time. We will notify users of significant changes through the app or via email. Continued use of Gallery Mirage after changes constitutes acceptance of the updated terms.
